Yes, that's mike's point. It's irrelevant though because regulating marriage is a legal power of the states and the Feds have to recognize it once DOMA is thrown out.

Why are you so sure that DOMA is going to be throw out when you admittedly have no idea what the issue is that may decide it?
DOMA and Prop 8 are two different issues.
DOMA will get tossed because the feds don't have the power to regulate marriage.
Prop 8
might get thrown out due to standing rules. I don't know the standing rules, it's just what I've read/heard on the news.
