Yes, that's mike's point. It's irrelevant though because regulating marriage is a legal power of the states and the Feds have to recognize it once DOMA is thrown out.

Why are you so sure that DOMA is going to be throw out when you admittedly have no idea what the issue is that may decide it?

DOMA will get tossed because the feds don't have the power to regulate marriage.

Prop 8 might get thrown out due to standing rules. I don't know the standing rules, it's just what I've read/heard on the news.

Here's why:

When the states seceded the feds didn't have to recognize it because the secession wasn't legal.
When the states regulate marriage (or allow gay marriage), the feds have to recognize it because legal authority over marriage resides within the individual states.

Do you recall any time, in the history of the US, when the Feds stepped in with regard to marriage laws dictated by the states?

Anyway, do you believe states' rights prevent Federal interference on all issues?
