Soooo.....what happens in the 39 states that do not recognize/allow SSM?

Lawsuits demanding equal rights?
Probably will see suits in every state very soon I would think.

The fact that he wants a homosexual marriage. (I'm assuming he does, I don't know for sure)
Neither of us knows that.

Also, the federal court above him upheld the ruling. If his decision hadn't been legally sound, it would have been overturned.

Let's say I'm a judge.  I have to make a ruling on issue X.

If I rule one way on issue X, I collect 1 million dollars.
If I rule the other way, nothing changes in my life.

Would you rather me be the judge? Or someone else who does not have this option of collecting money?
But he's not getting $1 million. That's the point. Everyone has a sexuality. It would be impossible to find a judge whose sexuality didnt fall on one side or the other.
This....if a straight judge ruled the other way, would people say they were biased?

If he rules one way on issue Y, he has the ability to marry his lover.
If he rules the other way, nothing changes in his life.

The analogy works.

So a straight judge couldn't be biased against homosexuality? Bullshit.

Sure he could.  Do you think there's an equal chance of that impacting his decision, as compared to Walker?

EDIT: Worded poorly.  Do you think there's an equal chance of this situation happening, and then having it impact his decision, as compared to Walker?
6/26/2013 11:31 AM
Yes I do.

EDIT: how many judges do you know?

I think it's just as likely that there's a straight judge biased against homosexuals.

OK.

What percentage of homosexuals who want to be married to their partner would be for SSM? For the sake of argument, 90%?

What percentage of heterosexuals are biased against homosexuals?  Is it less than 90%?  Is it significantly less than 90%?

Am I crazy here?

Had Marshall gone into the Supreme Court a year earlier, would he have had to recuse himself from the Loving case?
6/26/2013 11:47 AM
I don't know. All of us would be going the Biz way of making up numbers and facts by Quantifying anything of the sort.

Do you think the percentage of judges that could form unbiased opinions is greater or less than ordinary citizens?

Holyfuckshit.

A gay judge ruling in favor of SSM is just as likely as a straight judge ruling against it.

Are you straight?
Are you in favor of SSM?
Do you know any gays who are not in favor of SSM?
Do you think any gays are not in favor of SSM?

Edit:
Why would a homosexual be AGAINST SSM?

I hold judges to a higher standard than joe citizen. That his ruling was upheld by numerous other judges says all you need to know.
