High-Capacity Assault Weapons Topic

1)  Rights are something that the government gives you.  Stop kidding yourself.  Do you have the right to smoke anywhere you wish?  Do you have the right to posess an RPG launcher?  Does farmer Joe need a Bushmaster .223 slung across his back while watering his Romaine lettuce crop to protect himself and his crops from a warren of hungry bunny rabbits?

2)  See number 1.  Can hunters hunt with land mines, bazookas, or flamethrowers?

3)  Stop with the "tyrannical government" nonsense.  Save it for your manifesto.

The 1994 Assault Weapon ban only prevented the manufacture or illegal import of assault weapons.  It did not make it illegal to own or sell a pre-existing weapon covered by the ban.  So it did not remove any weapons off the street.

In short, it was a half-assed implementation, which is why it made little to no impact.

Bring the ban back, but without the grandfather clause.  Lets see what happens.

1 and 2 I love the fact that in order to get a gun ban you will sign on to a philosophy you dont really believe. Smoking isnt Really is right. The 2nd Amendment is a limit on the government's ability to limit your rights. spelled out in black and white. We as a society allow for some regualtions to make society run smoother. We have allowed the conversation to become about what weapons dont we need as opposed to what solutions can best help society.

3 Just keeping the conversation in an historical perspective. The same people who have always wanted to ban guns are out again.

The idea that the Clinton AG ban was too small scares me. It included a large amount of weapons. While it was true that it had some grandfather clauses it was in effect for years and prvented maufacture or import of any new guns. And while the press confrences showed big scary weapons it included many guns that no one would think of as military style.

And it didnt seem to do anything.

"Lets see what happens"??? Sorry not nearly good enough. Areas with gun bans have the highest crime and areas with 2nd Amendment freedoms have the lowest crime. True story.

I just dont want them to have the same degree of freedom as everyone else.

So now The white House has put banning guns by executive order on the table, and they are trying to bully retailers that sell personal firearms into going along with Obama, we can only guess at he downside of a refusal.

And of course if anyone in the NRA implies that the Government is coming for your guns they are acting insane!

I wouldn't worry about it, I'm fairly confident any executive order banning the sale of firearms would come under heavy scrutiny and likely not stand, and any EO banning the possession of any firearm would be struck down quickly.  It's obviously a bad precedent, even if the intentions are entirely pure.

Hopefully, this is just Joe Biden talking with his clown shoes on.  

While I think we need to reevaluate gun control and the intended scope of the Second Amendment, the thought of Obama attempting to define or clarify the Second Amendment on his own via executive orders seems to be a very slippery slope.  I don't think that's what executive orders are intended to be used for.

If he seriously considers going this route, we should all be scared.

Obama has been pretty active in making what he wants to happen. I am not sure it will stand up to Constitutional muster but what are we going to do in the meantime.

Stand up to Federal Marshals?

Would never get that far. 

If Obama attempted to do something via EO, it would be challenged immediately, an injunction would be sought (and granted), and this would get fast-tracked through the lower courts all the way up to the Supreme Court.

This would be an extremely foolish thing for him to do.  He's smart enough to realize that.  I think his ego is also massive enough that he understands the risk in how this would affect his legacy.

Of all the faults I can attribute to Obama worrying about his legacy isnt one of them. He is purely agenda driven. He wants to chage the very nature of America to be more in line with Euro-Socialism.

Also what would be the irrepadarable damage that could be deomonstrated to get the injunction?

I realize this isnt likely. It seems like Obama would never do this.

It didnt seem like Biden was going rogue when he made the comment. Almost like it was planned to put it out there and use Biden as a shield.

So what is the point?
