Around 285 cases going back to the 1840's will fall into the unconstitutional category is what it seems to be.

Has this devolved to a "He did it too!!!!" argument?

He made appointments that were unconstitutional.     That really should be the end of it.

And it is still subtly different.

Obama did this in the face of the Senate Republicans. They were running the technicality so he couldnt do it and he still did it. He was appearently told of the risk and didnt care.  He knew that there was going to be a challenge and he still did it.

As is common for Obama he pushed the envelope and did things no one else did and assumed he would get away with it.

I get why they did it, I get why Obama did what he did. When I see what happened in this case, I really get an idea of what douchebags the dems were when they did it. ******* politicians playing games because each side thinks they have to win.....all while we lose. Sick of it. The implications of this could run pretty deep when you look at it a bit further. It will be an interesting decision for the Supreme Court.

Like Jefferson with the Louisiana Purchase, Jackson with the Trail of Tears, Lincoln with habeas corpus, or FDR with internment of American citizens convicted of no crime?

I guess I'm not being very clear.   The President should UPHOLD the Constitution not violate it.    That's kind of in his job description.

There is a difference between pushing the envelope of Presidential powers and simple going to far.

This is another example of Obama not being good at being President.

Truthfully, if he did as a matter of national security/emergency, I get it.    The Repubs were playing games, Obama said "Screw this" and appointed people to the Labor Board.   It wasn't a pressing issue.   It's just a case of Obama thinking he's bigger than the Constitution.
