The IRS checks your return. They will look for the form. If it's not there, you owe the money. The good news is that the worst thing they can do to you is take it out of your return (or next year's return). The IRS's enforcement power is weak regarding this penalty. They can't put a lien on your bank account like they usually can with unpaid taxes.
So, in essence, the law is toothless?    I can claim 9 dependents and never expect a refund when my taxes are filed.    Nice loophole.

It's a $95 penalty. Even if they took it directly out of your bank account without your consent, the mandate is next to toothless.

Monumental waste of time and resources to pass a law that is:

A) toothless and unenforcable
B) going to be dismantled(or at least reconstructed in a way that makes it unrecognizable) as soon as a Repub takes the White House

In regards to pushing everyone towards the exchange it is already happening in a "backdoor" type of way.

A company a friend of mine works in HR, says that the increase for insurance will be pretty high, and either they can eat the cost, pass the cost onto their employees, or choose a third option offered by Obama, join the exchange and receive a tax credit...

Obama definitely wants everyone on the exchange as part of his grand scheme.
That's a good point. People will all start moving towards the exchanges if the exchanges are a better deal. This will force insurance companies to change the way they operate if they want to stay in business. They won't be able to pay $16 for advil anymore and will put pressure on hospitals to revise their pricing, bringing down the cost of healthcare for everyone.

There you go, tec. Issue addressed by the ACA. No need to repeal.

If you're going to force health insurance companies to accept everyone with pre-existing conditions, you have to mandate that everyone buy coverage. Since most people want coverage, this usually isn't a problem. But there are some who don't and, while the law is mostly toothless, it does allow for some enforcement.

This seems to be a running theme with you. You jump into a topic that you don't know anything about and machine gun a bunch of asinine questions.

there are certain truths that many ppl just do not seem to ever get, like the fact that ppl's lives and health should not be used for profit. one day everyone WILL get it, prolly about the same time we see world peace. or maybe when we can settle on other planets or transport instantly like on star trek. until ppl get that life and health are not for profit, we will have same problems no matter what system is in place.

Maybe a good workmans comp settlement will do the trick??? Could at least allow for some hairclub for men treatments.

you aren't being very clear. what exactly are you suggeesting ppl wo insurance should do? try to get workman's comp? are you also suggesting they all need hairclub treatments? or was that just a bonus joke or something?
