If this isn't criminal, there is literally no mistake a cop can make that they can be held criminally responsible for.

I think, in your mind, a criminal act requires intent. It doesn't.

They were called to investigate a person wielding a gun, who was pointing it at people and acting in an erratic manner.  They arrived on the scene, and as they were pulling up the suspect started approaching them.  Exactly where his hands are doing, or where the gun was, we can't tell.  But they reacted to the situation that was presented to them.

Unless you want to suggest that while they were hanging out at the donut shop they decided they were going to kill the next black person they saw.

I heard cops sit around in donut shops playing rock, paper, scissors to see who gets to kill the next black person they see.

I've heard that rumor, also. Judging by the amount of unarmed black people they've killed recently (John Crawford, Jonathan Ferrell  , Tamir Rice , Eric Garner), it might be true.

Does anybody else get the impression that if BL were around in the 70's, he'd be spitting at returning Vietnam vets and screaming "BABY KILLER" at them?
