A failed drug test is still a failed drug test. Whether or not it falls under a drug policy that was adopted three years later is irrelevant.

Ortiz failed a drug test in 2003. Period.

Your pregnancy point is kinda valid, because early 2000s PED testing was about as reliable as early pregnancy tests were in the '70s. Either you are or you aren't, but the fact that the test says you are may only mean there's a 70 or 80% chance of that being true.
