What is the tie breaker for a hitter at Max Contract assuming the prior team is not in on the guy?

Does it matter how long the previous team would have had them on their roster? I thought I read somewhere that it was 7+ seasons - true or does it default to the previous owner no matter how long?

I'm not sure. I've not seen a previous team lose when they say they were all in.
