The Pennsylvania Supreme Court on Monday ruled that the state’s congressional map went so far to benefit Republicans that it “clearly, plainly and palpably” violated the state constitution.

The court, where Democrats have a 5-2 majority, blocked the use of the map in the 2018 midterm elections, ordered state lawmakers to begin to draw a new map.

The suit against the congressional map, which only challenged it under Pennsylvania’s state constitution, was one of the most watched voting rights cases in the country. The ruling could encourage groups to bring similar challenges against congressional gerrymandering cases in other states and bypass a ruling from the U.S. Supreme Court, which is currently considering two cases dealing with partisan gerrymandering.

Pennsylvania has been described as one of the worst gerrymandered states in the country, and analyses have found the map is responsible for at least three additional GOP seats in Congress. Republicans controlled the redistricting process in 2010 and drew the map to give them a considerable advantage. In the 2012, 2014 and 2016 elections they won 13 of the state’s 18 congressional seats, despite just winning about 50 percent of the vote.

Obstruction of justice in legislative redistricting case

On January 5, 2007, prior to the start of the scheduled criminal trial[13] Finneran pleaded guilty to one count of obstruction of justice in exchange for federal prosecutors' dropping perjury charges against him; the plea bargain allowed him to avoid jail time.[12] Federal prosecutors and lawyers for Finneran recommended that the once-powerful figure on Beacon Hill receive 18 months of unsupervised probation and a $25,000 fine. In return, Finneran agreed not to run for any elected political position in state, federal or municipal government for five years after his sentencing date. The US Attorney's office agreed to dismiss three counts of perjury against Finneran.

On November 14, 2003, he made misleading and false statements under oath in US District Court, according to the agreement. The seven-page document, signed by Finneran on January 3, 2007, states, "Defendant expressly and unequivocally admits that he committed the crime so charged in the indictment, and that he is in fact guilty of the offense so charged in the indictment." Finneran faced 16 to 21 months in prison if he was convicted on all counts stemming from criminal charges that he misrepresented his role in the creation of a legislative redistricting map that diluted the clout of minority voters.[14] Finneran lost his $30,000-a-year pension after his plea.[15] A decision in 2006 by the state Supreme Judicial Court permitted a pension to be revoked in a similar case of breach of public trust.[16] His attorney, Richard Egbert, has said Finneran never claimed he was totally uninvolved in the redistricting process and that he acknowledged in his testimony having about "half a dozen" conversations with leaders of the redistricting committee.[17]

The Commonwealth of Massachusetts Retirement Board voted in October 2012, that Finneran was not entitled to a government pension of about $32,900 a year due to his conviction of obstruction of justice in 2007.[18] Finneran appealed the Retirement Board decision to the Boston Municipal Court where a judge reversed the Board's decision, concluding that Finneran's conviction did not bear "a direct factual link to his position as a House Member and/or Speaker[.]" On April 5, 2017, the Supreme Judicial Court reversed that decision and reinstated the decision of the Retirement Board, holding that "[s]imply put, it is only because he had been Speaker of the House at the relevant time that he was in a position to testify as to the genesis of the redistricting plan and to do so falsely. This connection is enough to warrant forfeiture" under the relevant Massachusetts statute, General Law c. 32, § 15(4).[19]

Finneran is a Democrat.


Democrats. Guess what? Both parties do it. My city which has gone conservative got swallowed up by larger Democrat cities that we have noting in common with so the Democrats can keep their 9 seats in DC. It happens in every state by both parties.

There is no such thing as institutional racism for the 80th time. Banks don't look at skin color they look at wealth. If you want to say there is wealthism (is that even a word?) that is fine but banks will lend by zip code and don't care who owns which property. You need to smarten up and face facts.

Gerrymandering should be stopped for both parties.

It's ridiculous the way boundaries are drawn in EVERY. SINGLE. STATE.

Seriously, a ten-year old with a Thomas-guide (remember those?) and a ruler could draw better lines.

I am a son of immigrants so my ancestors had nothing to do with the Civil War. If it offends people they should be removed. The statues of communist leaders were removed in Russia.

Agreed. Take em down. Most of them were put up in the 20's anyway. If you want 'history', read a textbook. Oh wait, it was the SOUTH who banned books like Coming of Age in Mississippi? What happened to history?
