Why does a franchise league with a salary cap need a draft?

Does that mean that each player can only be on one franchise, like if the 76ers take Dr. J then the Nets can't take him?

you draft the franchise and then can pick from any player season that player played for that franchise - there will probably be 3 different Lebrons for instance Cavs-Heat-Lakers and so forth
