No, you have to meet his yearly and total requirements.   He'd accept 3/17.2m but not 5/17.2m.

Depends on the team.  An offensively stacked team will have no qualms about taking an out as they know they'll create more opportunities.    A pitching-challenged team needs outs so they will value the out.
