Supreme Court's Republicans rule that Wisconsin mail ballots must be returned by Election Day instead of postmarked by then & received a few days afterward.

Brett Kavanaugh endorsed a theory so radical that the court refused to adopt it in Bush v. Gore. How radical is Kavanaugh's theory? John Roberts felt compelled to reject it in a separate opinion, correctly noting that federal courts should keep their noses out of a state court's interpretation of its own state's election laws.

Gorsuch also endorsed Rehnquist's position in Bush v. Gore. And Kavanaugh joined his opinion. Both want to prevent governors, state courts, and state agencies from expanding voting rights—and have federal courts decide what how the legislature *really* wanted elections to be run.

This is in direct contrast with the same justices’ ruling in RNC v. DNC form April where they allowed ballots postmarked by Election Day and received up to a week later to be counted... further proof that this illegitimate voter suppression-loving Court is a factory of hypocrisy.

If there was really a big concern about ballots being counted AFTER Election Day then you’d also see those who are concerned advocating for on-time processing ballots received prior to ED, along with an upping of resources for mail delivery prior to ED. The GOP argues against both.

Kavanaugh issued what amounts to a veiled threat tonight that the court may need to block states from counting votes after election night. In other words he’s crafted into judicial-speak Trumps demands that the winner has to be known on election night.

Forgotten over the confirmation of Barrett is Mitch adjourning the Senate immediately after. No Covid relief as hospitalizations surge upward. They have time to ram through a justice to overturn ACA and Roe v Wade and try to screw with voting but no time to look after a raging pandemic. That’s the GOP.

In contract law, the "mailbox rule" states that the date that an acceptance is mailed (postmarked), not received, is determinative in creating a binding contract within a deadline. Why doesn't this principle apply to mailed votes, Brett?
