I believe that right now, every player on the 40-man roster must make at least 55k, and if he already makes 327k, I am guessing that salary cannot be decreased.
However, the player in question in this thread was not on the 40-man roster (and was < 6 yrs pro) at rollover..
But I get what you're saying--you would definitely never have that issue if the rule was *changed* to your way. Though you would still run into the issue if you wanted to promote a non-40 of course..
