Just acquired a player whom I assumed would be assigned to AAA. Tried to assign then found he was out of option so I have to assign to majors. Obviously I never looked to see option status, otherwise how/why?

What point are you at in the season. If its after the trade deadline put all your 40 man roster on revocable waivers, including the player you just acquired. Hopefully he will clear and then you can assign him to the minors without having go to ML.

Winter Meetings/Offseason

I'm looking to acquire a guy who is out of options, but I don't have room for on my 25-man roster right now. If I add him to the 40-man but leave him unassigned, will he be auto-released anyway? I would try to pass him through waivers and put him in AAA, but he has already been claimed ahead of me twice this season, so I doubt he would get through. We're still a ways off from the trade deadline, by the way.

I think he gets auto-released after 10 real life days if not assigned.

You can also try putting the player through waivers and hope no one claims him. A bit risky, but depends on the quality of the player.

Put him on waivers night before rule 5 draft roster freeze. No one will be able to claim because of roster freeze. But not sure if he can get drafted in rule 5, though.

I would imagine that if you put him on 40 and then put him on waivers at that point, he would be safe.

Nothing happens during roster freeze so it'd be like his waiver status starts the next day. The same reason trades don't get done during a roster freeze. Even if the trade happened 6 hours earlier. Everything gets pushed back.
