Torre throws the ball away and is charged with an error yet when the run scores Rasmusson is still charged with an earned run.
Isn't it an unearned run since he wouldn't have scored had he not advanced to 2nd on the error?

No. Runs only get unearned when the runner reaches first or home on an error (or when the third out of an inning would have been made if not for errors, and there has not been a home run).

This one is interesting because the general rule of thumb is to reconstruct the inning without the error and see if the run still scores. That's doesn't work here because there were no outs recorded in the inning and the game ended. I do agree with uncleal that because the batter did not reach on an error nor score on it, it is an earned run, I don't know that I've ever seen this play out this way before.

I understand the rule, but don't agree with it. He wouldn't have scored on the play if not for the error, therefore the error was responsible for the run.

in a real game wouldn't the official scorer have discretion????

Yes, in theory, but in reality they charge the ER virtually every time.  Kinda like how they have discretion as to who gets the win if the starter doesn't make it 5 innings, but almost always the next guy in gets it, even if he only gets one or two outs.
