I was in and out of the hospital last week...somewhat better now.

As far as the 2nd Amendment is concerned, there is a clear distinction (although it is completely lost on both the general public and legislators these days) between guns and arms. I am all for not only gun control but gun bans. When it comes to arms control, I side with Charlton Heston.

kinda. Good enough to be home now. I apreciate it, bro.

I went to high school with a girl named Eggelation and another with the name Lipschitz. Eggelation was a cow but Lipschitz was rather hot, if you could get past the name.

It's amazing how many people don't have a clue what the 2nd amendment is about from both sides of the aisle. I don't understand why there is so much debate around it. Our founders made it pretty clear what they meant by the 2nd amendment. It is in place to defend us from a tyrannical government. As i've reminded Tang, we take our freedoms for granted. Very few countries in our world's history have not turned tyrannical at some point. It is not inconceivable that America could follow the same path one day.

With most things regarding the Constitution, they use 21st Century definitions, morality and ethics on a document written in the late 18th Century. The wording is very precise and the meaning is very clear if you interpret it using contemporary context. Even they understood that attitudes would change over time. That's why God created amendments.

I'm an originalist. Interpret it based on what the author's said. Don't try to twist it to "make it fit." As you said, that's why we have an amendment process.

we observe major technological advancements every day.....we now imagine the unimaginable and then watch it happen.
in the days of the convention change was very slow........they did not and could not anticipate the issues that would develop over wording meant for a context now ancient history.....in some situations we have to look at the theme and sentiment but not literal wording ....that is why interpretation in accordance with modern life must be made sometimes.......the words are words of men...not infallible........some things require amendments but if congress refuses to act then courts must do right by society and make proper interpretations....sometimes the Court is forced to legislate when congress has abdicated their responsibility.

Damn right, and lord knows me and Gene, my 75 year old neighbor, with his two .45 and my nothing could stand up to the government and their <checks notes> Army.

Oh, its a completely dated amendment. Duh.

The court should NEVER legislate. That is outside of their powers. That is very, very dangerous. We have a balance of powers for a reason.
