The way a TRO is issued is, by definition, ex-parte and, therefore, violates due process. Since a temporary restraining order is a procedural move and has nothing to do with guilt, it is argued that this simply falls under public policy. But, public policy cannot violate the Constitution. Then again, public policy creates all sorts of minor inconveniences that technically violate our protected freedoms as granted in the Bill of Rights because society would come to a standstill if a literal interpretation of due process was enforced. But...

TRO's are part of the way american society works.......everywhere.
same with kids and child services.
emergencies and potential emergencies require a sudden and pragmatic response.
thats normal.

due process is often situational.
and often different per circumstances.

a TRO is a protective measure.
they are not public policy...they are codified laws.

you could call everything under the sun public policy.

i dont consent to your definition of authoritarianism.
since the first child there has been authority needed to protect life and freedom.
once again i know where you are coming from and i dont buy what you are saying about authoritarianism........you use that term too easily.
dictators and illegal govts rationalize authoritarianism........

I might be turning socialist.

If a high school kid posts crap or does something, it should be carried over into his adult life and not expunged as the liberals have insisted.

I think any sane person should be able to own a gun. Back round checks should be deep and extensive.

YOU DON'T NEED A GUN IN 3 DAYS.

Unfortunately the anti-gun libs have laws in some states that require former law enforcement to take tests and pay money every 3 or 6 months.

So you got stupid coming from two sides and you're stuck in the middle.

on dougs post ---- there was some really good honest stuff there.
most of us are a mixed bag of policies including me and including doug..
labeling is bad.
we need to get back to issues.
on gun control a lot of people in congress are purched by the nra.
most people from all spectrums like both me and doug
support strong background checks.

that law you cited must im sure be a rare law.

Fair enough but very interesting.

Authoritarianism is not necessarily a dirty word. To me, authoritarianism is how sociologist Juan Linz (Yale) defined it...
  1. Limited political pluralism, realized with constraints on the legislature, political parties and interest groups;
  2. Political legitimacy based upon appeals to emotion, and identification of the regime as a necessary evil to combat "easily recognizable societal problems, such as underdevelopment and insurgency;
  3. Minimal political mobilization and suppression of anti-regime activities;
  4. Ill-defined executive powers, often vague and shifting, which extends the power of the executive
Most of those things we now have. The ones we don't we are moving towards. America has been rationalizing authoritarianism for a long time. What you are describing I would call totalitarianism.

you are maybe the smartest.....at least an equal if not smarter to italy prof.
in real life context i think it is very distracting to bandy around the term.
even the patriot act involves balancing and judicial permission after meeting some thresholds.
the purpose is clearly not intended to limit liberty in order to empower leaders....protection of america whether or not misguided is the purpose.
i believe there is authority...sometimes abuse or excess of authority but authoritarianism is a whole different aminal .
authoritarianism is a feature of tyrannical or totalitarian govt where restriction on liberty is never meant to help the individual or safeguard people but to prop up a govt that wants to strengthen itself at the expense of the individual.

you have to look at purpose and intent and good faith......before using that loaded word.
so the japanese internment camps were authoritarian and the current internment camps are authoritarian and trump is authoritarian and he - HE - is trying to make america as authoritarian as he is able to give himself as much personal power as possible.

and in years to come there will be much analysis on this....perhaps michael bechiloss can tackle it...i wish arthur schlesinger and richard hofstader was here.
