Still stuck on this Kavanaugh concurrence claiming that states announce the winner on election night. They don’t. News organizations project based on the trajectory of incoming results. And furthermore, it’s not uncommon for close races and states to be undeclared for days. What a dishonest hack.

Kavanaugh KNOWS how this works. He was on a team in Florida that argued for the inclusion of ballots received 10+ days after election day, and pressed counties to change their totals over THANKSGIVING weekend. When the courts change he has only himself to blame with this “opinion.”

It's really hard to believe that a justice on the US Supreme Court would put something this stupid in print. Voting by mail is legal and valid. Which means there isn't an election result to overturn until the valid votes are counted.

— You can’t start counting ballots when they arrive to provide an early count
— Quick results are so important that you can’t let late-arriving ballots be counted

That theory was too extreme for the Bush v. Gore majority. There is NO Supreme Court precedent to back up the 8th Circuit. This is a radical made-up theory Republicans are using to prevent states from counting ballots. he federal judiciary is dramatically expanding its power to police state election laws, to stop state courts and governors and election boards from protecting voting rights and counting ballots. The brazen partisanship of this decision from top to bottom is profoundly unsettling.
